Competition Rules – Win AirPods Max

1. Basic Information

1.1 The organizer of the competition is FUMBI NETWORK j. s. a., with its registered office at Nivy Tower, Mlynské Nivy 5, Bratislava – Staré Mesto 821 09, Company ID: 52 005 895, registered in the Commercial Register of the Bratislava III District Court, Section Sja, Insert No. 57/B (hereinafter referred to as “FUMBI” or “Organizer”).

1.2 The name of the competition is “Win AirPods Max” (hereinafter referred to as “Competition”).

1.3 The Competition runs from December 1, 2024, to December 20, 2024, until 11:59 PM (hereinafter referred to as “Competition Duration”).

1.4 The Competition is not sponsored, endorsed, or administered by META, Inc. (operator of Facebook and Instagram) or ByteDance Ltd. (operator of TikTok), nor is it associated with them in any way. META, Inc. and ByteDance Ltd. have no obligations towards the participants of this Competition.

2. Participation in the Competition and Conditions

2.1 The Competition is open to any individual over the age of 16 who has successfully completed their registration via https://fumbi.network (including its language versions) or any other website or software operated or owned by FUMBI (hereinafter referred to as “Platform”) and has fulfilled all other conditions as per these Competition Rules (hereinafter referred to as “Participant”).

2.2 To be eligible for the Competition and to claim the prize, all of the following conditions must be met (hereinafter also referred to as “Competition Conditions”):

a) Successful completion of registration on the Platform and agreement to the Terms of Use of the Platform and the User Agreement between FUMBI and the Participant;

b) Making a deposit of at least €100 in any FUMBI product (Fumbi Index Portfolio, Advanced Portfolios, Staking Portfolio, Custom Choice, or Bitcoin and Gold) during the Competition Duration;

c) Entering the promo code NOISE when making the deposit as per point b).

2.3 For the purposes of these Competition Rules, making a deposit refers to the crediting of funds to the FUMBI bank account listed on the Platform via bank transfer or another payment method supported by the Platform (hereinafter referred to as “Deposit”). The FUMBI bank account refers to the account associated with FUMBI products. Participants must make deposits exclusively using the methods and under the conditions stated on the Platform, and FUMBI may require specific payment details (such as variable symbols, constant symbols, or others) necessary to identify the Participant’s deposit. If the deposit is sent from a bank account, it must be sent from an account registered in the name of the Participant or from an account over which the Participant has authorization or equivalent rights; this applies similarly to other payment methods.

3. Announcement of the Competition, Evaluation, Notification of Results, and Prize

3.1 The Organizer will announce the Competition on December 1, 2024, via its social media channels, including Facebook, Instagram, TikTok, and other social networks managed or operated by the Organizer (hereinafter referred to as “Organizer’s Social Media”).

3.2 The winner of the Competition will be determined by a random draw.

3.3 The prize for the Competition is one pair of AirPods Max headphones. The prize will be sent to the winner via Slovak Post.

3.4 The winner will be contacted by FUMBI via the email address linked to their FUMBI account.

3.5 By participating in the Competition, participants agree to be contacted by the Organizer for the purpose of notifying them of the prize via the email address provided during registration, as well as to the related processing of personal data for Competition purposes.

3.6 The Organizer will announce the conclusion of the Competition via the Organizer’s Social Media, including information about contacting the winner.

3.7 The Participant or winner is not entitled to request financial compensation or any other replacement for the prize and has no entitlement to any claims against the Organizer other than those specified in these Competition Rules.

3.8 The Organizer will resolve any disputes, complaints, or objections regarding the Competition unilaterally and with final authority.

3.9 The Organizer reserves the right to verify compliance with the Competition Conditions and to unilaterally and definitively decide on any issues related to the Competition.

4. Exclusion from the Competition

4.1 The Organizer reserves the right to exclude from the Competition individuals who do not meet all the Competition Conditions specified in these Competition Rules.

4.2 The Organizer also reserves the right to exclude individuals from the Competition if there is reasonable suspicion that they have committed fraud, misused the rules, acted contrary to good morals, or fulfilled the Competition Conditions through fraudulent means. Fraudulent actions aimed at exploiting the rules include, for example, attempts to create multiple registrations by the same person (e.g., creating duplicate profiles). The Organizer’s right to exclude participants also applies to individuals who have violated these Competition Rules or who: i) Have not completed the verification of their identity as required by FUMBI’s conditions for full registration on the Platform and conclusion of the User Agreement; ii) Provided contact information, including email addresses, that is clearly incorrect, contains vulgarities, or includes language that contradicts generally acceptable social norms and ethics.

5. Consent to the Processing of Personal Data

5.1 By participating in the Competition, the Participant voluntarily grants the Organizer consent to process their personal data provided for the purpose of participating in the Competition.

5.2 The Participant has the right to request access to their personal data from the Organizer, the right to correct or delete their personal data, the right to restrict processing, the right to object to the processing of their personal data, and the right to data portability.

5.3 The Organizer retains the personal data of Competition participants only to the extent and for the duration necessary for the Competition.

5.4 This consent to the processing of personal data is voluntary. Revocation of consent during the Competition Duration is effective immediately upon receipt by the Organizer and results in the exclusion of the Participant from the Competition.

6. Final Provisions

6.1 If a Participant does not meet all the Competition Conditions properly and in time, they will be excluded from the Competition.

6.2 The Organizer is not obligated to reimburse Participants for any costs incurred in connection with their participation in the Competition. There is no legal entitlement to be included in the Competition. Participation in the Competition is non-transferable.

6.3 The Organizer reserves the right to shorten, extend, postpone, interrupt, cancel, or unilaterally modify or supplement the Competition rules at any time during its duration without compensation. Any changes to the Competition Rules will be announced in the same manner as the Competition itself. The Organizer commits to informing participants of such changes and making the new consolidated Competition Rules available.

6.4 The Organizer is entitled to verify compliance with the Competition Conditions and to unilaterally and definitively decide on any issues related to the Competition. The Organizer reserves the right to exclude a Participant from the Competition if they have violated these Competition Rules or acted in any way contrary to these Rules.

6.5 The Organizer unilaterally and definitively decides on any disputes, complaints, or objections related to the Competition.

6.6 This Competition is not a game of chance under the terms of Act No. 30/2019 Coll., as it is considered a promotional Competition under § 4 paragraph 6 of the act, which is not an independent business activity and serves only to promote the Organizer’s services. Deposits made to meet the Competition Conditions are not deposits under the act but rather payments made to participate in the Competition. The deposits made by participants remain in the form of crypto-assets credited to their accounts even if they do not win, and participants may manage these crypto-assets in accordance with the User Agreement.

6.7 Terms with capitalized initials not defined in these Competition Rules have the meaning specified in the User Agreement, which is available at https://fumbi.network/hu/felhasznaloi-szerzodes/.

These Competition Rules are published on the Platform’s website, and the effective date of these Rules is December 1, 2024.
