1. Basic Information 

1.1 The organiser of the competition is FUMBI NETWORK j. s. a, with registered office: Nivy Tower, Mlynské Nivy 5, Bratislava – Staré Mesto district 821 09, ID number: 52 005 895, registered in the Commercial Register of the District Court Bratislava III, section: Sja , insert no.: 57/B (hereinafter referred to as „FUMBI” or „Organiser„).

1.2 The name of the competition is „FUMBI 5th Birthday Competition” (hereinafter referred to as the „Competition„). 

1.3 The competition takes place in the period from 13.11.2023 to 22.11.2023 until 11:59 p.m. (hereinafter referred to as the „Competition Period„). 

1.4 Contestants have the opportunity to participate and win within the entire Competition Period.

1.5 The Competition is in no way sponsored, endorsed or administered by META, Inc. (operator of Facebook and Instagram) or ByteDance Ltd. (operator of TikTok) and has no affiliation with any of them. Neither META, Inc. nor ByteDance Ltd. shall have any obligation to any entrant in connection with the Contest.

2. Contestants and Competition Rules

2.1 Contestants of the Competition may be natural persons older than 16 years of age who have duly completed their registration in the FUMBI www.fumbi.network portal interface (hereinafter referred to as the „Portal”) or its language version and have fulfilled the other conditions as set out in these Rules and the terms and conditions of the Contest (hereinafter referred to as the „Contestant”).

2.2 A condition for inclusion in the competition is: 

(a) a duly completed registration of the Contestant on the Portal and the conclusion of the Agreement on the Terms and Conditions of Use of the Platform and the User Agreement between FUMBI and the Contestant, no later than the end of the Competiton Period (regardless of whether the fulfilment of the conditions pursuant to this point a. occurs during the Contest Period or earlier, i.e. prior to the announcement of the Contest);

b) making a Deposit of at least EUR 100/ 460 PLN into the „Fumbi Index Portfolio” Product during the Competition Period; and

c) entering the promo code „fumbi05” when making a Deposit into the „Fumbi Index Portfolio” Product provided by the Organiser during the Competition Period.

The execution of the Deposit pursuant to point b) of the Rules and Conditions of the Contest shall be understood as the crediting of the funds of the Contestant in question to the FUMBI bank connection indicated in the Platform interface by bank transfer or by using another payment method supported by the Platform (hereinafter referred to as the „Deposit”). The FUMBI bank account means the FUMBI account associated with the „Fumbi Index Portfolio” Product. The Contestant is obliged to make the Deposit exclusively by the methods and under the terms and conditions set out on the Platform, and in this context, FUMBI may require the provision of specific payment details (specific symbol, constant symbol or other) that are necessary to identify the Contestant’s Deposit. In the case of sending a Deposit from a bank account, it is required to be sent from a bank account under the name of the Contestant or from an account in respect of which the Contestant has a right of disposition or other similar right; this shall also apply mutatis mutandis in the case of the use of any other means of payment.

2.3 Persons in a working relationship with the Organiser and persons who are family members of persons in a working relationship with the Organiser are excluded from the Competition.

2.4 The Organiser reserves the right to exclude from the Competition any entrant who fails to comply with the terms and conditions of the Competition or any Entrant who engages in conduct which is contrary to good manners and is likely to affect the results of this Competition. The Organiser’s right to exclude Contestants from the Competition shall also apply to Contestants who have violated the terms and conditions of the Competition or those candidates for the Competition: i) who have not completed the verification of their identity in order to fulfil the Organiser’s conditions for full registration on the Platform and conclusion of the User Agreement, ii) whose contact details, including email address, are manifestly incorrect, contain vulgarisms or other verbal phrases that are contrary to generally acceptable social morals and ethics.

2.5 By participating in the Competition, the Contestant also consents to the publication of his/her name and the municipality in which the Contestant’s place of residence or long-term residence is located. These will be published on the Organiser’s Social Media, as defined in Article 3.1 of these Competition Rules and Conditions, which the Contestant agrees to by participating in the Competition.

3. Announcement of the Competition, evaluation, announcement of the results of the Competition and the prize

3.1 The Organiser will announce the Competition on 13.11.2023 via its social networks, in particular the Fumbi.network Facebook profile, the fumbi.network Instagram profile, the Tiktok profile or other social networks set up or operated by the Organiser (hereinafter referred to as the „Organiser’s Social Networks”).

3.2 The Organiser will determine the winner of the Competition by drawing lots.

3.3 The prize in the Competition is 1x iPhone 15 and 4x funds worth 100 EUR (in words: one hundred euros). The physical prize will be sent to the winner via Slovak Post. Funds will be credited to the winner’s account set up on the Portal to the product Fumbi Index Portfolio provided by the Organiser.

3.4 The winners will be contacted by FUMBI after the draw via the e-mail address associated with the account on the Portal. 

3.5 In connection with participating in the Competition, the Contestant agrees to be contacted by the Organiser for the purpose of informing about the win via the e-mail address entered during registration, as well as to the related processing of the Contestant’s personal data for the purposes of the Competition.

3.6 The Organiser will announce the end of the Competition on 27.11.2023 at the latest via the Organiser’s Social Networks with information about contacting the winner.

4. Other Conditions of the Competition

4.1 Competitors or the winner are not entitled to demand financial or any other payment instead of the prize and are not entitled to any other payments from the Organiser except those specified in these terms of the Competition.

4.2 The Organiser decides on suggestions, complaints or objections regarding the Competition unilaterally and with finality.

4.3 The Organiser reserves the right to shorten, postpone, suspend or cancel the Competition without compensation or to unilaterally amend or supplement the Competition rules throughout the duration of the Competition by announcing a change to the Competition rules in a manner identical to the Competition announcement. The Organiser undertakes to inform about the changes made and to make available the new, consolidated Rules and Conditions of the Competition when changing these Rules and Conditions of the Competition.

4.4 The organiser is entitled to check the fulfilment of the conditions of the Competition and make a final and unilateral decision on any issue related to the Competition. The Organiser reserves the right to disqualify a Contestant from the Competition or not to award the prize to the Contestant if the Contestant has violated the terms of the Competition or acted in a similar manner that is contrary to the terms of the Competition.

5. Contestant’s Declaration and Consent to the Processing of Personal Data

5.1 By participating in the Competition, the Contestant voluntarily grants the Organiser consent to the processing of their personal data, which they provided to the Organiser for the purposes of entering the Competition, evaluating it and awarding the prize.

5.2 The Contestant has the right to request from the Organiser access to personal data concerning the person concerned, has the right to correct personal data, the right to delete personal data and the right to limit the processing of personal data, the right to object to the processing of personal data, as well as the right to portability of personal data.

5.3 The Organiser stores the personal data of the winners exclusively to the extent and for the period necessary for the purposes of the Competition and for the purposes of awarding the prize, but not longer than 6 months from the date of the announcement of the Competition.

5.4 This consent to the processing of personal data is voluntary. Withdrawal of consent during the duration of the Competition is effective at the moment of its delivery to the Organiser and results in the exclusion of the Contestant from the Competition.

6. Final provisions

6.1 Capitalised terms not defined in these Competition Terms and Conditions shall have the meanings set out in the User Agreement, which is available at https://fumbi.network/en/user-agreement/. 

6.2 These Competition Terms and Conditions are valid from 13.11.2023 (i.e. the date of the Competition announcement) until the winners are announced.
